What is a “personal injury”* and can I claim compensation?

Personal Injury* is the legal term used to describe and injury to the body, mind or emotions which has been caused by the fault of another person or entity. Put another way, personal injuries* include soft tissue damage to the muscles or skeleton of the body; cuts, bruising and scars; fracture injuries; sprains, ligament or tendon damage; brain/head/ facial injuries; quadriplegic and paraplegic injuries; amputations; loss of a limb/organ/hearing/sight/sense of smell; dental injuries; injuries caused by medical negligence*; occupational stress; depressive disorders; psychological trauma including post traumatic stress disorder.

The most common types of situations giving rise to a personal injury claims* include road traffic accidents*; accidents at work*; slip/trip accidents*; assaults*; defective footpaths/public areas*; defective products, i.e. food poisoning; medical and dental mistakes or misdiagnoses*.

If you have suffered a personal injury* as a result of the fault of another person or entity you may be entitled to compensation* through the Injuries Board or through the Civil Courts. The level of compensation* you may be entitled to will depend upon the severity of the personal injuries* suffered, the medical treatment involved and the prognosis for recovery.
